1. Introduction
Welcome to Chasing Seconds Co. These Terms of Service ("Terms") govern your use of our website and services. By accessing or using our website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our website or services.
2. Definitions
"We," "Us," "Our": Refers to Chasing Seconds Co.
"You," "Your": Refers to the user or customer of our website and services.
"Website": Refers to chasingsecondsco.com.
"Services": Refers to the buying, selling, sourcing, and consignment of pre-owned luxury watches.
3. Eligibility
You must be at least 18 years old to use our services. By using our website, you represent and warrant that you meet this age requirement.
4. Account Registration
To use certain features of our website, you may need to register for an account. You agree to provide accurate and complete information during the registration process and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
5. Buying Watches
Product Descriptions: We strive to provide accurate descriptions of the watches we sell, including detailed condition assessments, specifications, and authentication documentation. However, we do not warrant that the descriptions are accurate, complete, reliable, current, or error-free.
Pricing: All prices are subject to change without notice. Prices do not include applicable taxes or shipping and handling charges, which will be added to your total invoice amount.
Order Acceptance: We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in the description or price of the product, or errors in your order.
Payment Methods: We accept wire transfer, Zelle, Venmo, and cryptocurrency (with an additional 1.5% processing fee for crypto transactions). We do not accept credit card payments.
Shipping: All watches are shipped via FedEx insured overnight delivery. Shipping costs and insurance are the responsibility of the buyer unless otherwise agreed upon.
6. Watch Sourcing Services
Sourcing Deposit: A non-refundable 10% deposit is required before we begin sourcing a specific watch on your behalf. This deposit will be applied to the final purchase price if you proceed with the purchase.
Deposit Refund Policy: The 10% sourcing deposit is non-refundable only if we successfully source your requested watch and you choose not to proceed with the purchase. If we are unable to source your requested watch, the deposit will be refunded in full.
Sourcing Timeline: Sourcing timelines vary based on the rarity and availability of the requested timepiece. We will provide estimated timelines and regular updates throughout the sourcing process.
No Obligation: Upon presenting sourced options, you have no obligation to purchase. However, the deposit is forfeited if you decline a watch that meets your originally specified criteria.
7. Selling and Consigning Watches
Evaluation: Watches submitted for sale or consignment will be evaluated by our team through authentication and condition assessment. We reserve the right to refuse any watch for any reason.
Consignment Terms: Consignment commission rates typically range from 10-20% depending on the watch's value, brand demand, and condition. Exact commission rates will be disclosed in writing before consignment begins. You retain ownership of the watch until it is sold.
Outright Purchase Offers: Offers made for outright purchase of your watch are valid for a limited time as specified in the offer. If you accept our offer, you agree to transfer ownership of the watch to us upon receipt of payment.
Payment: Payment for watches sold to us will be made via wire transfer, Zelle, Venmo, or cryptocurrency as agreed upon during the transaction process. Consignment payments are processed after the buyer's payment clears.
Shipping for Sellers: Sellers are responsible for shipping watches to us via fully insured shipping (FedEx or UPS recommended). Shipping address: 4542 N 92nd Ln, Phoenix, AZ 85037.
8. Returns and Refunds
Return Policy: We do not currently offer returns on purchased watches. All sales are final.
Why No Returns: We provide exhaustive photography, detailed condition reports, comprehensive authentication documentation, and complete transparency before purchase to ensure you buy with confidence. Every watch is accurately described and authenticated before sale.
Pre-Purchase Communication: We encourage all buyers to ask questions, request additional photos, and communicate with us via WhatsApp (954-736-6245), phone, or email before finalizing a purchase.
9. Authentication and Warranty
Authentication: All watches sold by Chasing Seconds Co undergo our multi-point authentication process, including serial verification, loupe inspection, movement analysis, case and bracelet stamp verification, and timegrapher testing. Authentication is performed independently by Chasing Seconds Co and is not affiliated with or endorsed by original watch manufacturers.
Warranty: Chasing Seconds Co does not provide any warranty on watches sold. Some watches may include remaining manufacturer warranty coverage from the original manufacturer, which will be disclosed at the time of sale if applicable. Transfer and validity of any manufacturer warranty is subject to the original manufacturer's terms and conditions. Chasing Seconds Co makes no representations or guarantees regarding manufacturer warranties.
Service and Repairs: We can recommend trusted watchmakers for service and repairs. Service history is disclosed when known, but we cannot guarantee the service history of pre-owned watches unless documented.
10. Independent Dealer Disclosure
No Manufacturer Affiliation: Chasing Seconds Co is an independent luxury watch dealer. We are not affiliated with, authorized by, sponsored by, or endorsed by Rolex S.A., Omega SA, Montres Tudor SA, Audemars Piguet Holding SA, Officine Panerai SA, Zenith SA, or any other watch manufacturers whose products are featured, referenced, or sold through our website or services.
Trademark Usage: All registered trademarks, brand names, logos, model names, and reference numbers are the intellectual property of their respective owners and are used solely for the purpose of identification and description of pre-owned timepieces offered for sale. The use of such trademarks does not imply any endorsement, affiliation, or commercial relationship between Chasing Seconds Co and the trademark owners.
Pre-Owned Watches: All watches sold by Chasing Seconds Co are pre-owned unless explicitly stated otherwise.
11. Trade-In Services
Trade-In Evaluation: If you wish to trade in a watch toward the purchase of another timepiece, we will evaluate your trade-in and provide a valuation that will be applied as credit toward your new purchase.
Trade-In Terms: Trade-in valuations are subject to authentication and condition verification upon receipt. Final trade-in credit may be adjusted if the watch's condition differs from what was represented.
12. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
(i) your use or inability to use our services;
(ii) any unauthorized access to or use of our servers and/or any personal information stored therein;
(iii) any interruption or cessation of transmission to or from our services;
(iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party;
(v) any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the services; and/or
(vi) the defamatory, offensive, or illegal conduct of any third party.
13. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions.
14. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Continued use of our services after changes become effective constitutes acceptance of the revised Terms.
